Terms & Conditions

Terms and Conditions

**Last updated: July 19, 2our access to and use of the Ishmaya website, online store, products, content, features, and related services.

The terms “Ishmaya,” “we,” “us,” and “our” refer to Ishmaya Healings and Wellness LLP, having its registered and operational office at:

F-302, MRG The Balcony, Sector 93, Near Hayatpur Village, Gurugram, Haryana 122505, India.

The terms “you,” “your,” “customer,” and “user” refer to any person accessing our website, creating an account, communicating with us, or purchasing our products.

Our online store is hosted and supported by Shopify. Shopify provides the e-commerce platform that enables us to offer our products and services to you. However, all purchases made through the Ishmaya store are transactions directly between you and Ishmaya Healings and Wellness LLP.

By accessing our website, creating an account, placing an order, or using any part of our services, you agree to these Terms and Conditions, our Privacy Policy, Cancellation, Replacement and Refund Policy, Shipping Policy, and any other policies published on our website.

If you do not agree with these Terms and Conditions, you should not access or use our website or services.

1. Eligibility and Account Information

You must be legally capable of entering into a binding contract under applicable law to place an order through our website.

If you are under the age of majority, you may use the website or place an order only under the supervision and with the consent of a parent or legal guardian.

When creating an account or placing an order, you agree to provide accurate, current, and complete information, including your:

  • Name

  • Email address

  • Mobile number

  • Billing address

  • Shipping address

  • Payment information

You are responsible for maintaining the confidentiality of your account credentials and for all activities carried out through your account.

You must inform us immediately if you believe that your account has been accessed or used without authorisation.

We may suspend or terminate an account where the information provided is false, incomplete, misleading, fraudulent, or being used in violation of these Terms.

2. Product Information

We make reasonable efforts to display and describe our products accurately. However, the appearance of colours, textures, sizes, finishes, and other product details may vary depending on your screen, device, lighting, photography, and display settings.

Crystals, gemstones, minerals, wooden products, handmade products, and other natural materials may contain natural variations, including differences in:

  • Colour

  • Shade

  • Pattern

  • Texture

  • Shape

  • Size

  • Transparency

  • Inclusions

  • Veins

  • Surface markings

  • Minor cavities or irregularities

These characteristics are natural and make each product unique. They are not ordinarily considered defects, damage, or grounds for return, exchange, replacement, or refund.

Product measurements and weights mentioned on the website are approximate unless specifically stated otherwise.

3. Crystal and Spiritual Product Disclaimer

Information regarding crystals, chakras, intentions, energy, cleansing, manifestation, spiritual practices, or metaphysical properties is based on traditional beliefs, cultural practices, and personal experiences.

Our products and website content are intended for spiritual, decorative, lifestyle, or general wellbeing purposes only.

They are not intended to:

  • Diagnose, treat, cure, or prevent any disease or medical condition

  • Replace medical, psychological, financial, legal, or other professional advice

  • Guarantee a particular physical, emotional, spiritual, financial, relationship, career, or life outcome

Individual experiences and results may vary. You remain responsible for your personal decisions and for seeking advice from an appropriately qualified professional where necessary.

Unless a product is specifically described as suitable for consumption, skincare, bathing, or another particular use, it must not be ingested, applied to the body, added to food or beverages, or used in any manner that may cause harm.

Products should be kept away from children and pets where they contain small components, sharp edges, fragile materials, essential oils, herbs, or substances unsuitable for unsupervised use.

4. Cleansing and Energisation

Certain Ishmaya products are cleansed, energised, activated, or prepared after an order is received.

These practices form part of Ishmaya’s spiritual preparation process and do not constitute a medical, therapeutic, or scientifically guaranteed service.

Because products may be prepared or energised specifically for an individual order, delivered products are generally not eligible for return or exchange, except where the product is damaged, defective, missing, or incorrect, subject to our Cancellation, Replacement and Refund Policy and applicable law.

5. Orders and Acceptance

Placing an order constitutes an offer to purchase the selected products.

An order is considered accepted only after:

  • The payment or applicable partial payment has been successfully processed

  • Required order verification has been completed

  • The order has been reviewed and confirmed by us

An automated order confirmation does not necessarily mean that the order has been finally accepted or dispatched.

We reserve the right to reject, place on hold, or cancel an order for legitimate reasons, including:

  • Product unavailability

  • Incorrect pricing or product information

  • Payment failure

  • Suspected fraud or unauthorised payment activity

  • Incomplete or incorrect customer information

  • Failure to verify the order

  • Delivery restrictions

  • Unserviceable delivery location

  • Unusually large quantities or suspected unauthorised resale

  • Violation of these Terms

If we cancel a prepaid order after accepting payment, the eligible amount will be refunded in accordance with our Refund Policy.

6. Order Verification

We may verify orders before processing or dispatch. Verification may be conducted through telephone, email, WhatsApp, SMS, or another available communication channel.

You agree to provide accurate contact information and cooperate with reasonable verification requests.

Failure to complete verification within the requested period may result in the order being placed on hold or cancelled.

Order verification does not guarantee successful delivery. Customers remain responsible for providing a complete and accurate address and for being available to accept the shipment.

7. Prices, Taxes and Payments

All prices displayed on the website are in Indian Rupees unless another currency is specifically shown.

Prices, discounts, promotional offers, shipping charges, and product availability may change without prior notice.

The applicable price will ordinarily be the price displayed at the time the order is placed, except where there is an obvious technical, typographical, system, or pricing error.

Prices may include applicable GST where stated. Shipping charges, customs duties, import charges, payment fees, convenience fees, or other applicable charges may be shown separately during checkout.

You agree to provide accurate billing and payment information and confirm that you are authorised to use the payment method selected for the order.

We may use third-party payment gateways to process payments. We do not directly control their systems, processing times, security procedures, or service availability.

Ishmaya does not store complete card or banking credentials where payments are processed by an authorised third-party payment service provider.

8. Cash on Delivery and Partial COD

Cash on Delivery may be offered only for eligible orders, products, values, and delivery locations.

We may require an advance or partial payment before confirming or dispatching a Cash on Delivery order.

Any partial COD amount, verification fee, convenience fee, or advance payment will be governed by the conditions clearly disclosed at checkout and in our applicable payment or refund policies.

Where disclosed before purchase, a partial COD amount may be non-refundable if:

  • The customer refuses to accept the shipment

  • The customer is unavailable despite reasonable delivery attempts

  • Incorrect or incomplete delivery information was provided

  • The order is returned because of customer-related non-delivery

  • The customer cancels after the order has been processed, energised, packed, or dispatched

Nothing in this section limits any refund or remedy required under applicable law where non-delivery or cancellation occurred because of an error attributable to Ishmaya.

We may restrict Cash on Delivery access for customers with repeated refused, cancelled, fraudulent, or undelivered orders.

9. Cancellations

Cancellation requests must be submitted within 2 days of placing the order.

A cancellation request may not be accepted if the order has already been:

  • Processed

  • Cleansed or energised

  • Customised

  • Packed

  • Assigned for dispatch

  • Handed over to the courier

  • Shipped

Cancellation eligibility and refunds are governed by our Cancellation, Replacement and Refund Policy.

10. Returns, Replacements and Refunds

Because products may be natural, spiritual, cleansed, or energised specifically for the customer, we do not accept returns or exchanges for change of mind, personal preference, expected spiritual results, or natural product variations.

We accept eligible claims for damaged, defective, missing, or incorrect products when reported within the period specified in our Cancellation, Replacement and Refund Policy.

A clear, continuous, and unedited unboxing video beginning before the package is opened may be required to establish an eligible claim.

Approved claims will ordinarily be resolved through a free replacement. A refund or store credit may be provided where an appropriate replacement is unavailable.

All cancellation, replacement, and refund requests are subject to our published policy and applicable consumer protection laws.

11. Promotions, Coupons and Gift Offers

Discounts, coupon codes, promotional offers, free gifts, bundles, and sale prices may be subject to separate terms, including:

  • Minimum order values

  • Eligible products

  • Validity periods

  • Usage limits

  • Payment-method restrictions

  • Geographic restrictions

  • Stock availability

Promotional benefits cannot be exchanged for cash unless expressly stated.

Only one coupon or promotional offer may be used per order unless the offer specifically allows combination with another promotion.

Free gifts and surprise gifts are provided subject to availability and may differ from promotional photographs. They are not independently returnable, exchangeable, or refundable.

If an order qualifying for a promotion is cancelled or refunded, the promotional value, free gift value, or discount may be deducted from the refund where permitted by law and clearly disclosed.

12. Shipping and Delivery

Delivery timelines displayed on the website are estimates and are not guaranteed.

Delivery may be affected by circumstances including:

  • Courier delays

  • Weather conditions

  • Public holidays

  • Natural disasters

  • Government restrictions

  • Strikes

  • Customs procedures

  • Incorrect addresses

  • Recipient unavailability

  • Events outside our reasonable control

You are responsible for providing a complete and accurate shipping address, postal code, landmark, and mobile number.

We are not responsible for delays or failed delivery caused by incorrect, incomplete, or outdated customer information.

Risk of loss or damage remains subject to applicable law and the relevant courier records. If a shipment is lost or damaged during transit, you should contact us so that we can investigate the issue with the courier partner.

Our complete shipping terms are available in our Shipping Policy.

13. International Orders

International customers are responsible for confirming that products may be legally imported, possessed, and used in their destination country.

Customs duties, import taxes, clearance charges, brokerage fees, and other destination-country charges are ordinarily the customer’s responsibility unless expressly included during checkout.

Customs procedures may delay delivery. We are not responsible for delays, seizure, rejection, or additional charges imposed by customs or other government authorities where the shipment complies with the information provided by the customer and applicable export requirements.

Mandatory consumer rights available under the laws of the customer’s country will continue to apply where those laws cannot legally be excluded.

14. Resale and Commercial Use

Unless authorised by Ishmaya in writing, products purchased through our retail website are intended for personal or household use and not for commercial resale, redistribution, reproduction, export in commercial quantities, or unauthorised marketplace listing.

We may limit quantities or cancel orders where we reasonably believe that products are being purchased for unauthorised resale or fraudulent commercial activity.

15. Intellectual Property

Unauthorised use may result in suspension of access and appropriate legal action.

16. Reviews, Feedback and Customer Content

You may submit reviews, photographs, comments, testimonials, suggestions, or other content where this functionality is available.

By submitting such content, you confirm that:

  • The content is based on your genuine experience

  • You own the content or have permission to submit it

  • It does not infringe another person’s rights

  • It is not false, unlawful, abusive, defamatory, obscene, threatening, misleading, or fraudulent

  • Any incentive, free product, or compensation received in connection with the review has been disclosed

You grant Ishmaya a non-exclusive, worldwide, royalty-free licence to use, reproduce, edit, publish, translate, display, and promote submitted content for legitimate business and marketing purposes.

We may remove content that violates these Terms or applicable law. We are not obligated to publish or respond to every submission.

17. Third-Party Services and Links

Our website may contain links to or integrations with third-party services, including:

These third parties operate under their own terms and privacy practices.

We are not responsible for the independent content, availability, security, acts, omissions, or practices of third-party websites or service providers, except to the extent that liability cannot be excluded under applicable law.

You should review the applicable third-party terms before using their services.

18. Relationship with Shopify

Shopify provides the technology used to operate our online store. Shopify is not the seller of Ishmaya products and is not a party to the sale contract between you and Ishmaya Healings and Wellness LLP.

Questions, complaints, returns, replacements, and product-related claims must be directed to Ishmaya using the contact details provided in these Terms.

Nothing in this section limits any responsibility that Shopify may independently have under its own terms or applicable law.

19. Privacy and Personal Information

We collect and process personal information in accordance with our Privacy Policy and applicable data-protection laws.

We reserve the right to correct errors, update information, withdraw products, and cancel affected orders.

If payment has been collected for an order cancelled because of an error or unavailable product, the eligible amount will be refunded.

We do not guarantee that the website will always be uninterrupted, secure, available, or free from technical errors.

The remaining provisions will continue to remain valid and enforceable.

28. Waiver

A delay or failure by Ishmaya to exercise any right under these Terms will not constitute a waiver of that right.

Any waiver must be provided in writing by an authorised representative of Ishmaya.

29. Entire Agreement

These Terms, together with the policies referenced on the website, constitute the agreement between you and Ishmaya concerning your use of the website and purchase of products.
